Weekly Accident Roundup: August 30th, 2017

In this week's accident roundup, we look at a charter bus accident resulting in criminal charges, a settlement for a 2013 elevator accident, a new lawsuit following the recent SEPTA train accident, and a Montgomery County motorcycle accident involving serious injuries.

Bus Driver Faces Charges For Accident Involving Philadelphia Students

A bus driver is facing criminal charges for a charter bus accident that occurred on I-95 in Maryland in early 2017. The bus was carrying eighth grade students and staff members from Charles W. Henry School in Mt. Airy, Philadelphia. All 30 people on board suffered injuries in the accident, some of them serious.

The driver is being charged with negligent driving contributing to the accident and failure to drive in a designated lane. Investigators said video cameras from the bus show that the driver merged lanes and forced a car onto the shoulder of the road. The video suddenly ends as the car reaches the front of the bus.

Philadelphia Police Officers Settle Elevator Accident Lawsuit

Two Philadelphia police officers have settled a lawsuit over a 2013 elevator accident, in which they were both seriously injured. The lawsuit was against U.S. Facilities Inc. and Schindler Elevator Corp. The first company is responsible for maintaining city buildings, while Schindler that company's elevator subcontractor.

Both of these companies have been in the news recently for another elevator at the Philadelphia Criminal Justice Center in August of 2016. A sheriff's sergeant named Paul Owens was paralyzed below mid-chest in the accident, when the elevator car he was riding in shot upwards and crashed through the concrete ceiling at the top of the shaft. Owens and his wife currently have lawsuits pending against Philadelphia Municipal Authority,  U.S. Facilities, and two U.S. Facilities subcontractors.

Lawsuit Filed Following SEPTA Train Accident In Delaware County

One of the 30+ passengers injured in a SEPTA train accident in Delaware County earlier this month filed a lawsuit against the Southeastern Pennsylvania Transportation Authority last week. The lawsuit claims that SEPTA displayed carelessness in the accident, in which a train carrying over 40 passengers crashed into a parked train at the 69th Street Station in Upper Darby.

The man suffered a serious head injury in the accident, and was treated at a nearby hospital. SEPTA has declined to comment on the case, as the accident is still under federal investigation.

Montgomery County Woman Critically Injured In Motorcycle Accident

A Montgomery County woman suffered critical injuries in a 2-vehicle accident involving a motorcycle and pickup truck in Hereford Township on Tuesday, August 29th. She was riding as a passenger on the back of the motorcycle when the driver accidentally crossed into the westbound lane on Tollgate Road. The driver of the pickup truck swerved to avoid the motorcycle, but the two vehicles crashed into each other anyway.

Both the driver and passenger of the motorcycle were ejected from the motorcycle in the crash. They were transported to Lehigh Valley Hospital. The passenger was listed in critical condition, while the driver was listed in stable condition.

The driver and both passengers of the pickup truck were not injured in the accident. The driver of the motorcycle was cited by the police following the crash.

MEET OUR MANAGING PARTNER: BRIAN MITTMAN

“I have been working since I was 14. I have probably held at least two dozen different jobs and I’ve seen people injured and hurt. One of the reasons I got involved with disability law is that I have a very good family friend who has been disabled his entire life, and I’ve seen how he’s struggled in order to keep working and try to work. When I was presented with the opportunity to get involved with what’s called “disability law,” I was really thrilled to be able to not only practice being an attorney, but helping other people who really need to know things about what their choices are, what they can do, and what their future may hold.

I am originally from Maple Glen, PA and is a life-long Eagles fan.

I have focused on helping individuals with their workers’ compensation, social security disability and long-term disability claims, as well as obtaining financial security for individuals who have had accidents.

As part of helping workers’ and their families, I have also been active in teaching continuing legal education courses to other attorneys, provide free seminars and webinars to the public on how to protect their rights, and I am active in various organizations such as the National Organization of Social Security Claims Representatives, the Injured Workers’ Bar Association and the Workers’ Injury Law & Advocacy Group.”
