Weekly Accident Report For 7/26/2017

In this week's accident roundup, we take a look at two negligence lawsuits and a car accident involving a Philadelphia police car and a civilian vehicle.

Parents Sue Bar & Drexel Fraternities For Son's Brain Damage

Parents of a Drexel student who suffered a severe brain injury after being punched are suing the bar who served him and members of two Drexel frats for negligence. After a night of heavy drinking at Cavanaugh's River Deck in Philadelphia, 23-year old Ian McGibbon and two of his frat brothers got into a physical altercation with members of another fraternity. During the fight, McGibbon was knocked down and struck his head on cement, knocking him unconscious.

McGibbon's fraternity brothers carried him home and left him on a couch while the fraternity's "risk manager" watched over him until 6 AM, before going to sleep. McGibbon was left there until noon the next day, when his concerned parents went to the fraternity house to check on him.

McGibbon is struggling from several serious injuries, including a spastic left arm, seizure disorder, severe headaches, concentration problems, anxiety, depression, and other psychological and emotional injuries. The student's brain swelled overnight, and his condition would likely be far less severe if he had received medical treatment immediately following the injury.

His parents have filed a lawsuit against the two frat brothers who brought him back to the house, the fraternity's risk manager, the student who allegedly knocked out McGibbon, and another student who was involved in the fight. Both fraternities and Cavanaugh's River Deck are also named in the suit.

2 Philly Police Officers, 1 Civilian Injured In Car Accidentphiladelphia police officers and car

Two Philadelphia police officers and one other person were injured in a Northwest Philadelphia car accident on Wednesday, July 26th.

The officers were responding to a report of an armed person, when their car collided with another vehicle at the intersection of Stenton Avenue and East Upsal Street. All three injured parties were taken to Einstein Medical Center. The police car suffered severe front-end damage, while the other vehicle was damaged on the driver-side rear-end.

The cause of the accident was not immediately known.

Couple Collects Settlement In Lawsuit Against Harrah's Philadelphia Casino

A Delaware County couple recently collected a settlement after suing Harrah's Philadelphia Casino and its operating companies for negligence related to a leg injury. Richard Rice stepped in a hole in the parking garage, which was covered by a rubber matting strip. According to court documents, Mr. Rice claimed to have suffered severe sprains in his left knee and left ankle during the fall. Harrah's later covered the hole with a wood-like plank.

Mr. Rice was seeking damages in excess of $50,000 plus costs, interests, and other relief. His wife Melissa was seeking equal damages for loss of consortium.

The amount of the settlement has not been disclosed.

MEET OUR MANAGING PARTNER: BRIAN MITTMAN

“I have been working since I was 14. I have probably held at least two dozen different jobs and I’ve seen people injured and hurt. One of the reasons I got involved with disability law is that I have a very good family friend who has been disabled his entire life, and I’ve seen how he’s struggled in order to keep working and try to work. When I was presented with the opportunity to get involved with what’s called “disability law,” I was really thrilled to be able to not only practice being an attorney, but helping other people who really need to know things about what their choices are, what they can do, and what their future may hold.

I am originally from Maple Glen, PA and is a life-long Eagles fan.

I have focused on helping individuals with their workers’ compensation, social security disability and long-term disability claims, as well as obtaining financial security for individuals who have had accidents.

As part of helping workers’ and their families, I have also been active in teaching continuing legal education courses to other attorneys, provide free seminars and webinars to the public on how to protect their rights, and I am active in various organizations such as the National Organization of Social Security Claims Representatives, the Injured Workers’ Bar Association and the Workers’ Injury Law & Advocacy Group.”
