What is being done to help those affected?

A knowledgeable and qualified attorney may be able to help if you or someone you know has suffered from an adverse vaccine reaction.

The National Vaccine Injury Compensation Program (NVICP) was created by the federal government in 1986 to compensate individuals, or families of individuals, who have been injured by vaccinations. The vaccines covered under the NVICP are diphtheria, tetanus, pertussis, measles, mumps, rubella, polio, hepatitis B, chicken pox, and rotravirus. Injuries resulting from these vaccinations include anaphylaxis, paralytic polio, and encephalopathy.

Compensation for vaccine injuries are under the jurisdiction of the National Vaccine Injury Compensation Program, you must first file a petition with the United States Court of Federal Claims in Washington, D.C. Your claim will be reviewed by a Special Master appointed by the United States Court of Federal Claims in Washington, D.C. To qualify, you must be able to show that the injury was caused by the vaccination and the extent of injuries. Decisions of the Special Masters may be appealed to the United States Court of Federal Claims.

Is there a time limit for filing claims?
Yes. In the case of an injury, the effects must have continued at least six months after vaccine administration and the claim must be filed within 36 months after first symptoms appear. In the case of a death, the claim must be filed within 24 months of the death and within 48 months after the onset of the vaccine-related injury from which the death occurred.

Are vaccines necessary?
There is no question that vaccines have reduced or in some cases even eliminated the risk of certain diseases. However, there is a preponderance of evidence demonstrating that vaccines are not without risk.

What can you expect from The Disability Guys Pennsylvania?

Benefits of The Disability Guys Pennsylvania

Finding a Vaccine Injury law firm is not easy. As a client, you will want to retain a Vaccine lawyer that you feel comfortable with. It is an important step picking a law firm for your particular lawsuit. You will also want to feel at ease with the law firm. Lastly, you will want to establish communication and not be thrust in their voicemail maze in order to talk to a human being.

If we sign a contract, you receive my cell phone number. And yes, I answer the phone; not my secretary nor my paralegal. And if I’m not in, leave a message for me and I will return your call or see that it’s returned within a day. Now’s that service — especially in the legal world.

Why do I do that? Let’s just say that I like to treat people the way that I like to be treated. I hope you’ll return my phone calls quickly too.

My experience and knowledge base complements their know-how and zealous work ethic. I have been on the executive committee and steering committee of multi district litigation. We work as a team on the behalf of clients just like you. We know what it takes to fight the pharmaceutical companies and big business. And, it all works on your behalf.

Let me help you take the mystery and fear out of choosing a Vaccine law firm.

Start here
The first thing we ask is for you to fill out a Vaccine Injury Pre-Case Form (case.asp). There is never an obligation to continue. At this point we don’t know if we’re the right law firm for you or vice versa but it’s the most logical way to begin. All your information will be held in the strictest confidence.

Decisions, decisions
After we receive the pre-case form, it will be reviewed to determine whether or not our law firm can help you. We will most likely ask more questions to gather information before making a decision. At this point — we have not agreed to represent you — and more importantly, you have not yet agreed to retain us. Representation can only happen when you and The Disability Guys Pennsylvania enter into a written agreement covering all the details.

Us and them
The average person feels powerless because the thought of one person fighting a multi-million dollar pharmaceutical company seems overwhelming. And processing your own claim in the Vaccine Injury Program can seem overwhelming as well. That’s why hiring a law firm makes sense. Most often you are not alone as thousands of people may be filing lawsuits and you could be part of a class action lawsuit or you could be filing a solo civil suit. The Disability Guys Pennsylvania has a successful track record fighting for what’s right, fighting on behalf of people just like you who trusted the system and the drug companies to make them well and to protect them from sickness instead of making them sick.

Q&A
You have questions; we have answers. It’s perfectly acceptable to ask a law firm about their experience, procedures, and costs. We listen to your concerns and outline the process. With over 30 attorneys, many leaders in their field, The Disability Guys Pennsylvania is devoted to handling product negligence and personal injury lawsuits.

How much does a lawsuit cost?
It costs you nothing. Really. If we agree to be retained*, we take your case on an hourly basis which is paid by the Vaccine Injury Compensation Program. You pay nothing out of pocket, ever! If you don’t win your vaccine case, you owe us nothing. No recovery; no fees. The likelihood of a successful lawsuit varies based on the facts of each case. Each person’s use of vaccines varies and will affect the outcome of any lawsuit. There are also case specific issues, involving the handling of each unsafe vaccine lawsuit.

Can you hear me now?
If you have signed a contract retaining us, then you receive Brian Mittman’s cell phone number for questions or the status of your litigation. You can also reach him via email.

Take the first step and fill out the Vaccine Injury Pre-Case Form and let the process begin.

What is the problem?

Known side effects to vaccines range from headache and other “flu-like” symptoms to seizures or complications that are more serious. Researchers have reported a possible link between the vaccine for Hepatitis B and multiple sclerosis, a finding that has been hotly disputed by the vaccine makers and some doctors. An article in the journal Lancet concluded that there was a possible connection between the MMR vaccine and autism.

The problem is compounded by the fact that vaccinations are required by law. Parents who refuse to have their children immunized face potentially serious legal problems. Children who are not immunized may not be allowed to attend public schools.

Thus, parents have no choice but to put their child at risk. Again, the potential for an adverse reaction from a vaccine is extremely low. However, the possibility does exist.

What is being Done?

Concerns over the safety of vaccines have led the FDA to recommend that vaccine makers stop using Thimerosal. Congressional hearings over the possible connection between vaccines and autism proved inconclusive, but the hearings did succeed in raising public awareness of the problem.

Litigation over mercury poisoning from vaccines began March 2001 with a lawsuit filed in Dallas, Texas. Similar lawsuits have also been filed including a class action lawsuit in Ontario, Canada on behalf of children who developed autism after receiving vaccines preserved with Thimerosal, a mercury derivative.

Thimerosal is being gradually phased out of most vaccines. However, it is too late for those children who have already been affected. Research is also being done on the connection between MMR and autism, hepatitis and MS, and other adverse reactions.

What can you do?

Vaccines are not like other medications in that you cannot simply discontinue treatment. Once the vaccine is in the body, the effects of the vaccine are there to stay.

If you or someone you know has been injured or has suffered an adverse reaction from a vaccine, you may be entitled to monetary compensation. Other medications are coming under increased scrutiny as well. An informed attorney may be able to help you decide if you have a legitimate case against the manufacturers of these vaccines.

MEET OUR MANAGING PARTNER: BRIAN MITTMAN

“I have been working since I was 14. I have probably held at least two dozen different jobs and I’ve seen people injured and hurt. One of the reasons I got involved with disability law is that I have a very good family friend who has been disabled his entire life, and I’ve seen how he’s struggled in order to keep working and try to work. When I was presented with the opportunity to get involved with what’s called “disability law,” I was really thrilled to be able to not only practice being an attorney, but helping other people who really need to know things about what their choices are, what they can do, and what their future may hold.

I am originally from Maple Glen, PA and is a life-long Eagles fan.

I have focused on helping individuals with their workers’ compensation, social security disability and long-term disability claims, as well as obtaining financial security for individuals who have had accidents.

As part of helping workers’ and their families, I have also been active in teaching continuing legal education courses to other attorneys, provide free seminars and webinars to the public on how to protect their rights, and I am active in various organizations such as the National Organization of Social Security Claims Representatives, the Injured Workers’ Bar Association and the Workers’ Injury Law & Advocacy Group.”
